How long is a power of attorney valid? Term and notarial form

In everyday life a power of attorney is often needed: to collect a document on someone else's behalf, to drive a car, or to handle property matters. Yet the simplest questions — "how many years is a power of attorney valid?", "what happens if no date is written?" — often go unanswered. In this article we explain the main rules based on the relevant articles of the Civil Code.

What is a power of attorney?

A power of attorney is a document by which one person (the principal) grants another person (the representative) the authority to carry out certain actions on their behalf. The representative acts within the authority stated in the power of attorney. That is why it is important to check its text carefully, especially its term and date.

How many years is a power of attorney valid?

Under the Civil Code, a power of attorney may be issued for any term. The main rules are as follows (Civil Code, Articles 362.2, 363.1 and 363.3):

SituationWhat the law says
A term is stated in the power of attorneyValid for the stated term
No term is statedValid for 1 year from the date it was made
The date it was made is not statedThe power of attorney is void (invalid)
It grants the right to dispose of a vehicleThe term cannot exceed 1 year
An undated power of attorney has no legal effect. Before signing or accepting a power of attorney, make sure the date is stated.

How long is a vehicle power of attorney valid?

A power of attorney granting the right to dispose of a vehicle cannot be issued for more than 1 year (Civil Code, Articles 362.2–363.3). So even if a longer term is written in the document, this statutory limit must be taken into account. After the term expires, a new power of attorney is issued if needed.

When must a power of attorney be notarised?

The law defines the form of transactions as follows: transactions are made in oral or written (simple or notarial) form (Civil Code, Article 329.2). If the Code does not require a special form for a particular type of contract, the contract may be concluded in any form (Article 406.1).

An important rule for powers of attorney: a power of attorney for making transactions that require notarial form must also be notarised (Civil Code, Article 363). Failure to observe the required form may make the transaction invalid (Article 329.1).

What to watch for in real estate matters

If actions involving an apartment or other real estate are carried out under a power of attorney, it is useful to know: ownership of immovable property passes to the acquirer from the moment the transfer is registered in the state register of immovable property (Civil Code, Articles 178.1 and 139.1). In other words, signing the contract alone is not enough — state registration also matters.

A practical checklist when acting under a power of attorney:

  1. Is the date it was made stated in the power of attorney?
  2. Is a term stated? If not, 1 year applies.
  3. If it is for a vehicle, is the term no longer than 1 year?
  4. If the transaction requires notarial form, is the power of attorney also notarised?
  5. Do the representative's powers cover the actions needed?

Summary

  • A power of attorney may be issued for any term; if no term is stated, it is valid for 1 year.
  • A power of attorney without the date it was made is invalid.
  • A power of attorney to dispose of a vehicle is issued for no more than 1 year.
  • For transactions requiring notarial form, the power of attorney must also be notarised.
  • Ownership of real estate passes from the moment of registration in the state register.
